iii. Private Utility Locates: Private utility locates, relocations, or repairs are not included in the quote. The Customer is responsible for locating and marking all private utilities.
d) Permitting & Site Surveys: Unless explicitly included in the written quote, Customer shall be solely responsible for: (a) obtaining and maintaining all necessary permits, licenses, and approvals; (b) providing certified site surveys; and (c) ensuring compliance with all local codes and regulations. Customer acknowledges that any delays or additional costs resulting from permit issues, survey inaccuracies, or regulatory compliance are Customer’s responsibility and may result in additional charges and/or schedule modifications. Any delays due to permit issues are not the responsibility of Bliss. Permit fees are not included in the quote unless explicitly stated. If permitting required, material cannot be ordered until permit(s) approved. Bliss Products & Services, Inc cannot be responsible for delays in schedule due to permit approval. In most circumstances, a permit must be approved by all jurisdictions prior to the order being submitted to manufacturing. This is a means to protect all parties from changes requested through the permitting department(s)
e) Water & Electrical Access: The Customer must provide water and electrical sources for use during installation. Failure to do so may result in project delays or additional charges.
f) Site Restoration: Bliss will smooth the jobsite upon completion, but full site restoration (e.g., replacing sod) is not included unless specified in quote.
g) Staging & access to site: The Customer is responsible for providing a designated area for material staging, employee parking, and access for trucks and equipment. Additionally, the Customer shall ensure the provision of necessary facilities, including but not limited to portable restrooms.
h) Force Majeure & Weather Delays: Bliss shall not be liable for any delays, damages or increased costs caused by weather, acts of God, labor disputes, material shortages, transportation delays, governmental actions, or other circumstances beyond Bliss’s reasonable control. Such events will automatically extend project timelines without penalty and entitle Bliss to equitable adjustments in price for increased costs. Weather conditions that prevent proper installation per manufacturer specifications shall be deemed legitimate delay events. Customer acknowledges that certain installations require specific temperature and moisture conditions, and schedule modifications may be required to ensure proper installation.
i) Liability for Vandalism & Theft: Bliss is not responsible for any damage or loss due to vandalism, third-party damages, or theft during or after installation.
j) Customer Compliance with Manufacturer Guidelines and Warranties: The Customer agrees to comply with all manufacturer requirements and guidelines related to the products and services provided under this agreement. The Customer shall be entitled to manufacturer warranties only to the extent that such compliance is maintained. Bliss is not responsible for standing water or poor drainage unless specific drainage solutions are outlined in the project scope. Any post-installation drainage issues will not be covered unless the scope includes drainage provisions.
4. Tannins: Engineered Wood Fiber is a natural product, and the release of tannins (organic compounds) during the early stages after installation may temporarily discolor nearby surfaces or drainage water. This is a normal process, and Bliss is not liable for any staining or discoloration caused by tannins.
5. Site Access: Customer shall provide a minimum of 100 feet of level, unobstructed access for 53′ semi/tractor trailer deliveries, with no stairs, overhead obstructions, or tight corners that would impede access to the drop location. Customer acknowledges that failure to provide adequate access may result in additional delivery charges, project delays, or both. Bliss shall not be liable for any damage to landscaping, utilities, or structures resulting from vehicular access on paths designated or approved by Customer. Any restrictions in access that require smaller vehicles, or additional labor will result in extra charges.
6. Site Preparation and Restoration: The customer is responsible for ensuring that the site is properly prepared for installation, including grading and drainage. This proposal does not include site restoration. Any damage caused to the landscape, including ruts or disturbed soil, will not be repaired by Bliss unless site restoration services are specifically included in the project scope.
7. Skid Steer Usage: If the customer has not requested blow-in service for the mulch installation, a skid steer will be used to distribute the mulch.
